Reasons why Kesha lost her case:
- She’s asking the courts to decimate a contract that was heavily negotiated and typical for the industry. Granting the singer’s request to nullify her deal would undermine the laws governing contracts.
- Dr Luke offered to allow her to fulfill her contract and record without his involvement. She refused this deal because she feared the company would no longer promote her music. She claims she cannot work with him out of fear for her personal safety, but consequently chose her career over safety.
- In a deposition made in 2011, Kesha swore under oath that Dr Luke never assaulted or drugged her. The alleged rape happened ten years ago, and she swore under oath that it didn’t happen. How the fuck is the Judge supposed to rule in her favour? Because fans are screaming for it outside the court room? That is not how the fucking law works.
Kesha didn’t lose her case because of rape culture. Stfu.
That last point does seem rather damning.
I’d like to follow up on that last point. Does anyone have a source?
